My question is if fifth amendments should apply when government business is involved. Because then the fifth amendment changes from being a protection of the people from the state, to a protection of the state from the people.
How do you literally make him talk. Torture? Fifth amendment is clear in the language. Fauci committed crimes, they should investigate those crimes. Obviously he isn't going to incriminate himself.
If Howley is to be believed, Fauci doesn't have a Fifth Amendment right. Supposedly after you've been pardoned you don't have a Fifth Amendment right in relation to crimes that you've been pardoned for.
But it is possible he has more recent crimes he's committed where testimony regarding the past would relate.
I feel that's just nonsense talk by these political talking heads, they need some thing to talk about. Give people hope so they tune in. The fifth amendment doesn't say anything about not counting for someone that was pardoned. If we want it to we need to vote on a new amendment to the constitution. Not likely. I'm a fifth amendment absolutist. I don't like fauci but I'll fight to the death to defend his rights. He didn't want to commit perjury. He's pardoned for stuff till January 2025, that's passed, if he commits new crimes like perjury he can go to jail.
Trump just said he respects biden for pardoning fauci. Trump says biden used an auto pen so all of his pardons shouldn't count, except the one for fauci is all good. Trumps a fauci pal. If fauci somehow got arrested for something, trump would pardon him again. Rand Paul's senate committee can ask questions but trumps DOJ won't do anything to investigate covid.
