Just give everyone solitary, and it isn't a problem anymore. They say solitary is harder. So then you can make the sentences shorter, and it's a better deterrent. Better, it's a more uniform deterrent. Some people thrive in the social setting of a jail. Do you think they are strongly deterred once they get out? Social jailing is hell for some and a vacation for others. But if you made it bad for everyone, you'd have a more consistent product and achieve the deterrence at least more consistently. Then you could stop over-applying punishment for some, trying to achieve sufficient punishment for others.

I think the current jailing practices violate the 8th amendment. The government has almost any form of punishment at its disposal. But exposure to violence is not a constitutionally valid method of punishment. If they put you in a cage with actual animals, that would be cruel and unusual.

This is the same dimension of the problem with housing biological males with female attraction and violent histories, with women who have a reduced capacity to talk to the outside world. If the courts are aware that their predictable violence would be a deterrent to those inmates, then it constitutes intent under the same standards that the courts use to measure intent in criminal cases. Foreknowledge and benefit.

But if that logic holds, then the logic works categorically for any case where a court has foreknowledge that they are exposing someone to a risk of violence greater than they had outside of prison, and that could act as a dimension of punishment. It's wrong to lock up women with male rapists. But it is also wrong to lock up people who missed an alimony payment with violent gangs who will attempt to recruit them. Also, doesn't that just make the gang problem worse?

Gang members are in it to seem cool. You can be cool in a gang outside of prison. Then you can be cool in a gang inside prison. But there is nothing cool about sitting in a cell alone for 3 months. The sentences can get way shorter when the time is harder (but not violent).
