To me it's so simple. Government shouldn't be running sports. Then it doesn't have to be government policy.

What happens if the supreme court recognizes claims to rights that both parties have? The most likely result is that they will weigh some rights against others. But they have an opporutinity to recognize that the government can't run sports without violating somebody's rights (hypotetically) and say that government then can't do it. Then sports will go to private organizations where it belongs. It's the most unlikely outcome. But it is the one I'm hoping for.

It seems to me the only right at stake here is women's right to exclude males from their sports. i.e., the right to create an organization that excludes males. You're right, the government (and courts) shouldn't force them to allow males in.

Imho the obvious solution here is to create MtF and FtM categories in sports, let them compete among themselves.

Man, I've played enough competitive sports and I'm sure anyone else who has played them as well would agree, you're there to win. A rec league is different. No one really gives a shit. Drink beer and goof off but a competitive league... you're there to win. IMO this is 99% what this is all about. You're 422nd in the men's league but all the sudden you're now #1 along with scholarship and media attention... Give me a fucking break!

Playing off what 0x07 and xoenix said, there is only so much funding available from government to sports. (More then I think there should be. Why the fuck should any government money go to a stadium for a pro team?)

Funds would then have to be further divided if you were to introduce 2 more categories.

There was just a news report here about Canada's national women's rugby team having to do a fund raiser. I felt bad they have to do it but high end rugby in Canada is not popular at all. This is the main problem, there are soooo many different sports. Do you now have to fund 4 rugby teams? 4 curling teams? 4 pro video game teams??? There are so many "sports" these days and only so much cash to go around. (FYI rugby is a legit sport but curling.... video game teams.... for fuck sakes...)
